A proposed measure seeks to speed up the handling of Cebu City ordinance violations by assigning dedicated city lawyers to evaluate complaints, prepare cases and follow up on their filing before the Office of the City Prosecutor.
Councilor Joel Garganera is pushing for a more coordinated legal process, citing potential delays between the documentation of violations and the filing of complaints against those responsible.
Under the proposed resolution, the City Legal Office would designate lawyers to focus primarily on cases involving violations of city ordinances, from initial legal evaluation to preparation, filing and follow-up.
The measure aims to ensure that documented violations receive prompt legal assessment and that cases supported by sufficient grounds proceed to the appropriate prosecutorial office.
It covers violations of Cebu City ordinances in general, including those involving public order, safety, health, sanitation, environmental protection and traffic discipline. The proposal does not identify specific ordinances or categories of violations for priority handling.
Under the proposed arrangement, designated lawyers would coordinate with the city offices responsible for implementing and enforcing local ordinances.
Garganera’s proposal seeks to establish clearer responsibility and continuity in case handling while improving coordination between enforcement personnel and the City Legal Office.
However, the assignment of dedicated lawyers would not automatically result in every apprehension or documented violation being filed as a case. The proposed process would still require legal evaluation to determine whether a complaint warrants formal filing.
The Office of the City Prosecutor would remain the receiving prosecutorial office for complaints referred by the city.
The resolution does not specify how many lawyers would be assigned, whether the City Legal Office would require additional personnel or funding, or how quickly cases should be processed.
It also provides no figures on pending ordinance violation cases, current processing times or the extent of delays experienced by the concerned offices.
If approved, the measure would establish a more focused mechanism for pursuing documented ordinance violations, with the goal of improving enforcement while ensuring that cases undergo the necessary legal assessment.
The proposed resolution is scheduled for deliberation during the Cebu City Council’s agenda on Oct. 13.
